PURPOSE & SCOPE
These Terms & Conditions (“Terms”) govern the consultation, assessment, treatment, therapy, wellness, nature cure and related services provided by Akayukthi Nature Cure Centre (“Akayukthi”, “Centre”, “we”, “us” or “our”).
By making an enquiry, appointment, booking, payment or by commencing treatment at the Centre, the client/patient (“Patient”, “you” or “your”) acknowledges that they have read, understood and agreed to these Terms.
These Terms apply independently to the services provided by Akayukthi Nature Cure Centre and do not constitute the terms of accommodation provided separately by Valli Stay.
NATURE OF SERVICES
Akayukthi provides nature cure, wellness, therapeutic and related services based on individual assessment and professional recommendations.
Treatment plans may be modified depending on:
- The patient’s health status.
- Medical history
- Response to treatment
- Practitioner assessment
- Contraindications or safety considerations
- Changes in the patient’s condition
No treatment, therapy, programme or wellness service is provided with a guarantee of a particular result or outcome.
ACCURACY AND DISCLOSURE OF INFORMATION
Patients must provide complete, accurate and current information relevant to their care.
This includes, where applicable:
- Medical history
- Existing medical conditions
- Previous surgeries or procedures
- Current medications and supplements
- Allergies and sensitivities
- Pregnancy or possibility of pregnancy
- Previous or ongoing treatment
- Relevant mental or physical health information
- Any other information requested by the Centre or its practitioners
Failure to disclose relevant information may affect treatment safety and suitability.
Akayukthi shall not be responsible for consequences arising directly from materially inaccurate, incomplete, outdated or intentionally withheld information.
PROFESSIONAL ASSESSMENT AND TREATMENT DISCRETION
All treatments are subject to professional assessment and clinical suitability.
The Centre or its practitioner may:
- Modify a treatment plan
- Postpone a treatment
- Substitute a therapy
- Reduce or discontinue a treatment
- Recommend additional medical evaluation
- Recommend referral to another healthcare professional or hospital
Such decisions may be made where considered necessary for the patient’s safety or wellbeing.
PATIENT CONSENT
EMERGENCIES AND REFERRAL
BOOKING AND CONFIRMATION
PAYMENT
Payments may be made through the payment methods authorized by the Centre.
Applicable taxes and charges shall be payable in addition to the stated service charges where required.
Where payments are processed through a third-party payment gateway, the transaction may be subject to the gateway provider’s terms and processing timelines.
CANCELLATION
Cancellation requests must be made directly to the Centre.
No cancellation shall ordinarily be permitted once the applicable bill has been generated.
Cancellation requests received before billing may be considered by management at its discretion, taking into account the booking, treatment preparation, resources committed and timing of the request.
Once a treatment, therapy or residential treatment programme has commenced, cancellation shall ordinarily not be permitted.
Specific programme or booking terms communicated at the time of confirmation shall prevail where they expressly differ from these general Terms.
REFUNDS
Payments are generally non-refundable once the applicable bill has been generated.
No refund shall ordinarily be provided for:
- Consultations already conducted
- Treatments or therapies already provided
- Treatment plans already prepared
- Customized programmes
- Services already commenced
- Unutilized services after commencement of a programme
- Residential treatment programmes after commencement
For failed, reversed or duplicate payment transactions, any applicable refund shall be processed through the relevant payment provider or bank in accordance with its procedures.
Third-party processing delays shall not be attributable to Akayukthi.
RESCHEDULING
Subject to availability and management approval, a booking may be rescheduled within 10 days of the original booking date, provided the relevant service or programme has not commenced.
Once treatment or a residential treatment programme has commenced, rescheduling shall ordinarily not be permitted.
Any programme-specific rescheduling conditions communicated at the time of booking shall prevail.
MODIFICATION OF BOOKINGS
Requests to modify a confirmed treatment or programme are subject to:
- Availability
- Professional suitability
- Operational feasibility
- Applicable charges
- Management approval
Customized treatment plans and specially arranged services may not be transferable.
PUNCTUALITY AND MISSED APPOINTMENTS
Patients are expected to arrive at the scheduled time.Late arrival may result in a shortened session where the schedule does not permit an extension.Failure to attend a scheduled appointment without adequate notice may be treated as a missed appointment, and the applicable session or charge may be forfeited.
PATIENT CONDUCT
Patients are expected to maintain respectful and appropriate conduct towards practitioners, therapists, staff and other patients.
The following may result in discontinuation of services:
- Abusive or threatening behaviour
- Physical or verbal intimidation
- Harassment
- Deliberate disruption of Centre operations
- Violation of safety instructions
- Repeated non-compliance with reasonable Centre policies
- Unlawful conduct
Any action taken shall be subject to applicable law.
PERSONAL BELONGINGS
Patients are responsible for their personal belongings, valuables, documents, electronic devices and other possessions.
Akayukthi does not accept responsibility for loss, theft or damage to personal belongings except where liability is imposed under applicable law.
PHOTOGRAPHY, RECORDING AND CONFIDENTIALITY
Patients must respect the privacy of other patients and staff.
Photography, audio recording or video recording of other patients, treatment areas or staff without appropriate permission is prohibited.
The Centre may establish additional restrictions in areas where privacy or confidentiality is particularly important.
MEDICAL RECORDS AND CONFIDENTIALITY
Patient information, treatment records and health-related information shall be handled confidentially and accessed only for legitimate treatment, administrative, operational, legal or safety purposes.
Information may be disclosed where:
- Required for treatment or continuity of care
- Necessary in an emergency
- Required by law or a competent authority
- Necessary for payment or administration
- Authorized by the patient
- Otherwise permitted under applicable law
PRIVACY AND PERSONAL DATA
Akayukthi collects and processes personal information in accordance with its Privacy Policy.
The Privacy Policy forms an integral part of these Terms.
THIRD-PARTY SERVICES
The Centre may use third-party providers for payment processing, technology, communication, administrative services and other operational requirements.
Where a third party independently processes personal information, its own applicable terms and privacy practices may also apply.
FORCE MAJEURE
Akayukthi shall not be responsible for failure, delay, modification or interruption of services caused by circumstances beyond its reasonable control, including natural disasters, epidemics, government restrictions, infrastructure failures, severe weather, public emergencies or other unforeseen circumstances.
Where reasonably possible, the Centre may offer rescheduling or an alternative arrangement.
LIMITATION OF RESPONSIBILITY
The Centre will exercise reasonable care in delivering its services.
Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
CHARGEBACKS AND PAYMENT DISPUTES
Patients are requested to contact Akayukthi directly regarding any payment discrepancy or service concern before initiating a chargeback.
Where a payment dispute is found to be unauthorized or inconsistent with the booking or services provided, the Centre reserves the right to take appropriate action, subject to applicable law.
RIGHT TO REFUSE OR DISCONTINUE SERVICES
Akayukthi may refuse or discontinue services where continued provision would be unsafe, inappropriate, unlawful or materially inconsistent with Centre policies.
Where reasonably possible, the patient shall be informed of the reason and appropriate alternatives may be recommended.
CHANGES TO THESE TERMS
Akayukthi may periodically update these Terms to reflect changes in its services, operational practices or applicable legal requirements.
The version applicable to a booking shall ordinarily be the version communicated or made available at the time of booking.
GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the applicable laws of India.
Disputes shall be subject to the jurisdiction of the competent courts having jurisdiction over Akayukthi Nature Cure Centre, subject to applicable law.
